Terms of Service

Welcome to JamiezGiftz, a service operated by Jamiez LLC ("Company," "we," "our," or "us"). By placing an order or enrolling in our services, you agree to the following Terms of Service ("Terms").

1. Membership Priority and Ordering Queues

JamiezGiftz operates on a priority-access and limited-capacity model.

  • Member Priority Window: Active members are granted exclusive early access to place orders for gift basket offerings prior to a specified deadline.
  • Waitlist Access: If capacity remains after the member ordering deadline has passed, ordering will be opened to individuals on our waitlist.
  • Capacity Limits: All orders are queued in the order they are received until the maximum production limit for that specific offering is reached. Once the limit is reached, the offering will be closed to further orders.

2. Minimum Order Thresholds and Cancellations

To ensure the viability of our service, each gift basket offering is subject to a 25-unit minimum threshold. If we do not receive a minimum of 25 queued orders across all members and wait-listers by the stated deadline, we reserve the right to cancel the offering entirely. In the event of a cancellation, any pre-authorized payments or charges will be voided or fully refunded, and clients will be notified promptly.

3. Holiday and Occasion Baskets

JamiezGiftz offers baskets for scheduled holidays and other occasions. Each basket is a separate order, paid in full when you place it. There are no subscriptions, automatic enrollments, recurring charges or payment plans; you choose each basket you want when its ordering window opens.

4. Itemized Pricing and Fees

Upon successful queuing and fulfillment of an order, clients will receive an itemized receipt detailing the exact breakdown of costs. This includes:

  • The retail cost of the individual goods ("goodies") included in the basket.
  • Applicable California state and local sales tax.
  • A dedicated delivery fee.
  • A service charge for assembly and procurement.

5. Delivery Protocols, Safe Drop, and Undeliverable Items

JamiezGiftz provides exclusive local hand-delivery services within our designated service areas, including the Willow Glen neighborhood and surrounding San Jose zones. We do not ship gift baskets via mail or third-party freight under this service; shipping requests must be coordinated through www.jamiezshipz.com.

  • Pre-Arranged Deliveries: We coordinate delivery arrangements in advance to ensure successful hand delivery.
  • Safe Drop and Transfer of Risk: If the recipient is not present at the time of delivery, our personnel will leave the gift basket at the designated address if it is determined safe to do so. The determination of whether a location is "safe to leave" the basket is made in our sole and absolute discretion. Delivery is deemed fully and successfully completed at the exact moment our personnel capture a photograph of the basket at the delivery location (e.g., on a porch). Upon this completed delivery, all risk of loss—including but not limited to theft, damage by weather, or interference by animals—transfers entirely to the purchaser. Jamiez LLC does not guarantee against theft or damage once a delivery is completed in this manner.
  • Redelivery Attempts: If we determine in our sole discretion that it is not safe to leave the package, we will return the basket to our facility and attempt one (1) free redelivery on our next scheduled Route-day.
  • Office Hold & Disposal: If a basket remains undeliverable after the second attempt through no fault of Jamiez LLC, it will be held at our office for the purchaser to retrieve. Because our baskets contain perishable items, failure to successfully deliver or promptly retrieve the basket will result in its disposal. No refunds will be issued for baskets disposed of due to failed delivery attempts.

6. Limitation of Liability and Product Substitutions

While we strive to fulfill baskets exactly as advertised, we reserve the right to substitute unavailable items with goods of equal or greater value. Jamiez LLC is not liable for any allergic reactions or dietary complications arising from the consumable contents of the baskets.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings shall be brought exclusively in the courts located in Santa Clara County, California.
